These Terms of Use apply to all use of PhysioDock.com. This includes, but is not limited to:

  • The forum, where users can participate in professional discussions and share experiences.

  • AI tools, including interactive assistants and professional search features.

2.1 Legal name of the entity

The name of the entity is: PhysioDock.com.

For now, PhysioDock.com is operated as a private undertaking without a registered legal company name. When a registered company is established, this information will be updated.

PhysioDock.com does not currently have an organization/company registration number, as the site is not yet registered as a separate legal entity. Information will be published here as soon as it becomes available.

4. USER ACCOUNT

4.1 How to create an account (registration process)

4.1.1. Registration: To create a user account on PhysioDock.com, you must complete our online registration form. During registration you will be asked to provide:

  • Full name

  • Valid email address

  • Password (that meets our security requirements)

  • Optional professional information (e.g., job title if registering as a physiotherapist)

4.1.2. Email confirmation: After registering, you will receive an email to confirm your account. Your account is activated only after you click the confirmation link.

4.1.3. Optional additions: You may add a profile photo and a short bio to your profile, but this is voluntary.

4.2 Requirement for truthful and up-to-date information

4.2.1. Accurate information: You are required to provide correct, complete, and up-to-date information during registration.

4.2.2. Duty to update: You agree to update your profile if your details change, for example when changing your email address.

4.2.3. Consequences of false information: If you provide false information, PhysioDock.com may delete your account without notice.

4.3 Responsibility to protect username and password

4.3.1. Personal responsibility: You are solely responsible for protecting your username and password. Never share your login details with others.

4.3.2. Strong password: We recommend a strong password of at least eight characters, including uppercase letters, lowercase letters, numbers, and special characters.

4.3.3. Suspected misuse: If you suspect someone has gained access to your account, you must notify us immediately at contact@physiodock.com.

4.3.4. No liability: PhysioDock.com is not liable for loss or damage resulting from unauthorized use of your account.

4.4 Prohibition on transferring the account to others

4.4.1. Personal use: Your user account is personal, and you are not permitted to transfer it to others, whether temporarily or permanently.

4.4.2. No sale of accounts: It is strictly prohibited to sell, rent, or give away your account to others.

4.4.3. Breach consequences: If we discover that an account has been transferred or used by unauthorized persons, we reserve the right to suspend or delete the account immediately.

4.5 PhysioDock’s right to suspend or delete accounts in case of misuse

4.5.1. Right to act: PhysioDock.com reserves the right to suspend or delete user accounts in cases of:

  • Breach of our Terms of Use or guidelines.

  • Attempts at fraud or manipulation of our systems.

  • Harassment, hate speech, or other inappropriate content in forums or comments.

  • Misuse of the AI diagnosis bot or other services.

4.5.2. Notice: For less serious breaches, we will send a warning by email. For serious breaches, the account may be deleted immediately without prior notice.

4.5.3. Temporary suspension: PhysioDock may temporarily suspend an account while investigating suspicious activity.

4.5.4. No compensation: If your account is deleted due to a breach of the terms, you are not entitled to compensation for any lost data or purchased services.

4.6 How a user can delete their account

4.6.1. User-initiated deletion: You may delete your account at any time by:

  1. Logging in to PhysioDock.com

  2. Going to “My Profile” and selecting “Delete Account”

  3. Confirming the deletion by entering your password

4.6.2. Confirmation: You will receive an email confirmation when your account has been deleted.

4.6.3. Data handling after deletion:

  • Your personal information will be deleted or anonymized in line with our Privacy Policy.

  • Forum posts may be anonymized, but not necessarily deleted, to preserve discussion continuity.

  • Information that must be retained under applicable Norwegian law (e.g., purchase history) will be stored as required by law.

4.6.4. Recovery: A deleted account cannot be restored. If you wish to use PhysioDock.com again, you must create a new account.

5. AGE REQUIREMENTS FOR USE

5.1 Minimum age to create an account

5.1.1. Minimum age: You must be at least 18 years old to create a user account on PhysioDock.com. This age limit ensures users are of legal age and legally responsible for their actions on the platform.

5.1.2. Age verification: By registering, you confirm that you meet the age requirement. PhysioDock.com may request additional verification if we have reason to believe a user is below the age limit.

5.1.3. Service-specific limits: Certain services—such as forum discussions on medical topics or courses with professional content—may have higher age limits or require documented professional background.

5.2 Use by minors requires parental/guardian consent

5.2.1. Under 18: If you are under 18, you may only use PhysioDock.com if a parent or guardian has provided written consent. This applies especially to participation in courses, the forum, or the use of AI tools.

5.2.2. Consent form: Parental/guardian consent must be provided through a digital consent form that PhysioDock.com may require when needed. The consent must confirm that the guardian is aware of the child’s use and accepts the terms on their behalf.

5.2.3. Parental controls: Parents or guardians have the right to request insight into a minor’s account activity or request deletion of the account.

5.2.4. Limited access: Accounts created for minors may have restricted access to certain features, such as forum participation or purchasing digital products.

5.3 Consequences of breaching the age requirement

5.3.1. Account deletion: If we discover that an account was created by someone under 18 without valid guardian consent, we reserve the right to delete the account immediately.

5.3.2. Temporary suspension: If we suspect a breach of the age requirement, we may temporarily suspend the account until age is verified.

5.3.3. Blocking future access: Repeated attempts to bypass the age requirement may result in the user being blocked from creating new accounts on PhysioDock.com.

5.3.4. Guardian notification: If we discover that a minor has registered without consent, we may contact the listed guardian to inform them of the situation.

6. SUBSCRIPTION TERMS FOR PHYSIODOCK PLUS

6.1 Price and payment terms

6.1.1. Price: The subscription to PhysioDock Plus costs 199 NOK per month, VAT included.
6.1.2. Billing time: Payment is charged in advance at the start of each subscription period.
6.1.3. Payment methods: We accept the following payment methods:

  • Credit card (Visa, Mastercard)

  • Vipps

  • Stripe
    6.1.4. Electronic receipt: You will receive a receipt by email immediately after payment.

6.2 Auto-renewal and how to disable it

6.2.1. Auto-renewal: The subscription renews automatically at the end of each (monthly) period under the same price and terms.
6.2.2. Disabling auto-renewal:

  • You may disable auto-renewal at any time via “My Account” on PhysioDock.com.

  • You will retain access to PhysioDock Plus for the remainder of the paid period, but it will not renew further.
    6.2.3. Confirmation: You will receive an email confirming that auto-renewal has been disabled.

6.3 Notice period and how to cancel

6.3.1. Notice period: The notice period is 1 month from the date we receive your cancellation.
6.3.2. How to cancel:

  • Cancel via “My Account” or by sending a written request to contact@physiodock.com.

  • You will receive an email confirming your cancellation.
    6.3.3. Access after cancellation: You keep access to PhysioDock Plus through the notice period. Access then ends automatically.

6.4 If payment is late

6.4.1. Reminders: If payment fails, we will send reminders to your registered email address.
6.4.2. Temporary suspension: If payment remains outstanding for more than 7 days, we may temporarily suspend access to PhysioDock Plus until payment is received.
6.4.3. Termination: If payment is not received within 30 days, we may terminate the subscription.
6.4.4. No compensation for suspended days: Days of suspended access due to unpaid invoices are not compensated.
6.4.5. Collections: Continued non-payment may be referred to collections in accordance with Norwegian law.

6.5 No refunds for started subscription months

6.5.1. No refunds: Payments for started subscription periods are non-refundable, even if you cancel before the period ends.
6.5.2. No partial refunds: We do not offer partial refunds for periods during which the service is not used.
6.5.3. Exceptions: Refunds are only provided if you were incorrectly charged due to a technical error on our side.

6.6 Changes to subscription prices and terms

6.6.1. Notice of price changes: PhysioDock.com reserves the right to adjust subscription prices or terms.

  • Changes will be communicated by email at least 30 days before they take effect.

  • If you do not accept the new prices or terms, you may cancel before they take effect.
    6.6.2. Automatic acceptance: Continued use of PhysioDock Plus after the change date constitutes acceptance of the updated prices and terms.
    6.6.3. Price guarantee within current period: No price change will affect you mid-period. New prices only apply from the next renewal date.

7. NO MEDICAL ADVICE

7.1 PhysioDock.com provides information only, not professional medical advice

7.1.1. Informational purpose: All content on PhysioDock.com—articles, blog posts, videos, courses, and forum discussions—is for informational purposes only.
7.1.2. Not a substitute for care: Information published on PhysioDock.com is not, and should not be regarded as, medical advice, diagnosis, or treatment plans.
7.1.3. No doctor-patient relationship: Using PhysioDock.com does not create a doctor-patient relationship or any treatment relationship.

7.2 The AI diagnosis bot is advisory and not a substitute for healthcare professionals

7.2.1. Advisory function: The AI diagnosis bot on PhysioDock.com is solely a tool to provide general guidance and information based on entered symptoms and questions.
7.2.2. No medical diagnosis: The tool is not designed to make medical diagnoses or provide personalized treatment recommendations.
7.2.3. No guarantee of accuracy: Although we continuously update the tool with new information, results may be incomplete, inaccurate, or out of date.
7.2.4. Not for emergencies: The AI bot is not suitable for acute medical situations. For immediate help, always contact emergency services (e.g., 113 in Norway).

7.3 Users should always consult healthcare professionals

7.3.1. Consult professionals: We strongly recommend that you always seek qualified healthcare professionals for medical questions, assessments, and treatment.
7.3.2. Combine with professional judgment: Information on PhysioDock.com may supplement—but never replace—professional assessments from authorized healthcare providers.

  • Costs of replacement services or third-party solutions
    8.3.2. No liability for indirect damages: We are not liable for incidental, special, or indirect damages, including those arising from:

  • Misinformation from our articles or AI tools

10.2.1. External images: PhysioDock.com uses images that are freely available or licensed for reuse. We do not own images on our blog pages unless explicitly stated.

11.2 Prohibited content

11.2.1. Harassment, hate speech, or discriminatory content:

  • No harassment, bullying, hate speech, or discrimination based on gender, race, religion, ethnicity, sexual orientation, or disability.

  • Be courteous and respectful.
    11.2.2. Potentially harmful medical advice:

  • Do not provide personal medical diagnoses, prescribe treatments, or offer advice that could cause harm.

  • AI diagnosis bot outputs must be labeled as “advisory” and not a substitute for professional medical judgment.
    11.2.3. Marketing/advertising without permission:

  • No commercial promotion without written permission from PhysioDock.

  • Unauthorized affiliate links, contests, or sponsored posts will be removed.
    11.2.4. Illegal content:

  • Do not post content that violates Norwegian law, including copyrighted material.

  • No sharing of pirated content, illegal download links, or doxxing.

11.3 Moderation

11.3.1. Moderators’ role: Enforce guidelines and keep discussions professional and respectful.
11.3.2. Removal of posts: We may edit or remove posts that violate guidelines, including:

  • Off-topic, irrelevant, or spam content

  • Posts containing others’ personally identifiable information without consent

  • Content that violates copyright or other laws
    11.3.3. Suspension/bans:

  • Repeated violations may lead to temporary or permanent bans.

  • Severe violations (e.g., threats or hate speech) may trigger immediate permanent bans without notice.
    11.3.4. Warnings:

  • First violations typically receive an email warning.

  • Repeated violations lead to further measures, including suspension.

11.4 User responsibility for posted content

11.4.1. Your responsibility: Ensure your content is accurate, truthful, and professionally grounded; respect copyright and cite sources.
11.4.2. Privacy: Do not share sensitive information, including identifiable patient details.
11.4.3. License: By posting, you grant PhysioDock a non-exclusive right to use, share, and display your content within our services, marketing, or newsletters.
11.4.4. No compensation: UGC does not entitle you to compensation unless expressly agreed in writing.

11.5 Consequences of violations

11.5.1. Post removal without notice.
11.5.2. Suspension/ban for repeated or serious breaches.
11.5.3. Legal action may be taken for illegal content.
11.5.4. Loss of access to PhysioDock Plus without refund.

12. PROHIBITED CONDUCT (GENERAL SERVICE RULES)

12.1 No hacking, DDoS, or unauthorized access

12.1.1. No unauthorized access: Strictly prohibited to attempt to access PhysioDock.com or related systems without authorization, including:

12.5.2. No refunds: Users blocked for policy violations are not entitled to refunds for paid services or subscriptions.
12.5.3. Notice: Blocked users will typically receive written notice explaining the reason, unless immediate action is required due to severe security threats.

14. BREACH OF TERMS

In the event of a breach of PhysioDock’s Terms of Use, the following measures may be implemented, depending on the severity of the breach:

14.2.1. First breach: For minor breaches of the terms, the user will generally receive a written warning.
14.2.2. Content removal: Content that violates our guidelines may be removed without prior notice.
14.2.3. Recording of breaches: Repeated minor breaches will be recorded and may lead to stricter measures.

14.3. Temporary or permanent suspension from the platform
14.3.1. Temporary suspension: For repeated or moderate breaches, the user may be temporarily suspended. The duration of the suspension will be assessed based on the severity of the breach.
14.3.2. Permanent suspension: Severe or repeated breaches may result in permanent suspension from PhysioDock.com. This includes loss of access to the forum, courses, and PhysioDock Plus services.
14.3.3. Without notice in severe cases: In cases of serious breaches, such as attempted fraud, hacking, or harassment, suspension may occur immediately without prior notice.

14.4. Deletion of user account
14.4.1. Account deletion: In the case of severe breaches, PhysioDock.com may permanently delete the user’s account. This entails:
– Loss of all data associated with the account, including forum posts, course progress, and purchase history.
– No right to a refund for any ongoing subscriptions.
14.4.2. Notice of deletion: The user will receive written notice of account deletion, unless the breach is of such severity that immediate deletion is necessary.

14.5. Financial liability for losses resulting from breaches
14.5.1. Duty to compensate: If the user’s breach of the terms causes financial loss or damage to PhysioDock.com or our partners, the user may be held financially liable. This may include:
– Costs related to investigation and legal action.
– Lost revenue resulting from damage to the site’s reputation or functionality.
– Repair costs for damage to systems caused by hacking, DDoS attacks, or other unauthorized activity.
14.5.2. Debt collection: Unpaid claims may be referred to debt collection in accordance with Norwegian law.

14.6. Cooperation with authorities in the event of serious breaches

15.2.1. Acknowledgment of receipt: When we receive a copyright notice, we send a written confirmation to the notifier.

– Second violation: The user may be temporarily suspended from publishing content on the platform.

16. DISCLAIMER OF LIABILITY AND INDEMNIFICATION

16.1.1. Indemnification: The user agrees to hold PhysioDock.com, its owners, employees, partners, and suppliers harmless from any claim, loss, liability, expense, or damage (including legal costs) arising from the user’s:

16.1.3. Notification: PhysioDock.com will notify the user of any claims covered by this indemnification and give the user the opportunity to participate in the defense of the claim.

16.2. PhysioDock is not liable for indirect damages
16.2.1. Disclaimer for indirect damages: PhysioDock.com disclaims any liability for indirect, incidental, or consequential damages arising from the user’s use of the services. This includes, but is not limited to:
– Loss of profit, revenue, or business opportunities.
– Loss of data or interruptions to user services.
– Damage to the user’s equipment or software.
– Losses related to third-party links or content.
16.2.2. Disclaimer for technical errors: PhysioDock is not liable for damages resulting from technical errors, maintenance, network issues, or other technical causes that may lead to service interruptions.
16.2.3. No guarantee of results: PhysioDock makes no guarantee that use of our services (including the AI diagnosis bot and forum advice) will lead to desired health or business outcomes.

16.3. Maximum compensation from PhysioDock
16.3.1. Limitation of liability: PhysioDock’s total financial liability for any claim, regardless of basis (including breach of contract, negligence, or otherwise), is limited to the amount the user has paid for the services during the last 12 months.
16.3.2. No liability without payment: If the user has used PhysioDock.com without payment (e.g., free content or free courses), PhysioDock has no liability to the user.
16.3.3. No liability for unforeseen events: PhysioDock is not liable for losses or damages caused by force majeure events, including but not limited to natural disasters, war, strikes, pandemics, or other unforeseen events beyond our control.

17. SOLE REMEDY

17.1. The user’s sole remedy in case of dissatisfaction is to discontinue use of the service
17.1.1. Limited remedy: If you, as a user, are dissatisfied with PhysioDock.com, its content, services, or Terms of Use, your sole and exclusive remedy is to stop using the service.
17.1.2. Termination of subscription: If you have a paid subscription, you may cancel it at any time in accordance with our subscription terms.
17.1.3. No claims upon voluntary termination: Termination of use or subscription does not entitle you to compensation or a refund for the remaining period, unless otherwise specified in our subscription terms.

17.2. PhysioDock is not liable for additional claims or compensation
17.2.1. No additional claims: Upon discontinuation of use of the service, the user waives the right to bring additional claims against PhysioDock.com, including but not limited to:
– Financial loss (direct or indirect)
– Loss of profit, data, or business opportunities
– Compensation for lost time or effort
17.2.2. No compensation for damages: PhysioDock is not responsible for compensation for damages, inconveniences, or losses arising from the user’s decision to discontinue the service.
17.2.3. No compensation for lost expectations: Users cannot claim compensation for any expected results, success, or health improvements based on the use of content, courses, or AI tools from PhysioDock.com.

18. FORCE MAJEURE (DISCLAIMER FOR EXTRAORDINARY EVENTS)

18.1. PhysioDock is not responsible for service failures due to force majeure events
PhysioDock.com is not responsible for failure to fulfill its obligations if the failure is due to circumstances beyond our reasonable control (force majeure). This includes, but is not limited to:

– Failures in subcontractors’ services due to labor disputes.

– Failures by our hosting partners or technology providers.

18.2. No entitlement to compensation in force majeure events
18.2.1. No liability for damages: The user is not entitled to a refund, compensation, or any other form of remuneration if PhysioDock’s services are affected by a force majeure event.
18.2.2. Temporary unavailability: If our services become temporarily unavailable due to a force majeure event, this does not constitute a breach of contract.
18.2.3. Termination of services: If a force majeure event lasts for more than 30 days, PhysioDock reserves the right to discontinue the service without further liability to the user.

18.3.2. Measures to restore services: PhysioDock will take reasonable measures to minimize the impact and restore normal operations as quickly as possible.

19. TERMINATION OF THE SERVICE AND USER ACCOUNT

19.1. How the user can close their account
19.1.1. Termination via settings: The user may close their account at any time by:
– Going to “My Account” on PhysioDock.com.
– Selecting “Delete account” in account settings.
– Confirming the termination by entering their password.
19.1.2. Termination via customer support: The user may also close the account by contacting PhysioDock’s customer support:

– Contact form: Available at PhysioDock.com/contact
The user must provide their registered name and email address for identity verification.
19.1.3. Confirmation of termination: After termination, the user will receive written confirmation by email.

19.2. What happens to the user’s data after termination
19.2.1. Deletion of personal data: Upon termination, we will delete or anonymize the user’s personal data in accordance with our privacy policy and applicable law. This includes:
– Name, email address, and contact information.
– Payment history (stored in accordance with the Norwegian Bookkeeping Act for up to 5 years).
– Course progress, unless otherwise agreed.
19.2.2. Retention of user-generated content:
– Content published in the forum or comment fields may remain, but will be anonymized so it can no longer be linked to the user.
– The user may contact us to request removal of specific posts, subject to the integrity of the forum.
19.2.3. Backup data: PhysioDock may retain backups for a limited period (up to 90 days) after termination, but these will only be accessible for system recovery in the event of technical errors.

19.3. PhysioDock’s right to terminate a user’s access
19.3.1. Termination for breach of terms: PhysioDock has the right to terminate the user’s access with immediate effect if the user:
– Breaches the Terms of Use, including the forum guidelines.
– Engages in unauthorized use of AI tools or scraping of content.
– Commits illegal acts through the platform (for example, harassment, fraud, or copyright infringement).
19.3.2. Termination upon discontinuation of the service:
– If PhysioDock.com is discontinued, all active accounts will be automatically terminated.
– Users with ongoing subscriptions will be refunded any prepaid period beyond the discontinuation date.
19.3.3. No liability for compensation: In the event of termination by PhysioDock due to the user’s breach of the terms, the user is not entitled to a refund for unused portions of their subscription.

19.4. Notice period for termination by PhysioDock
19.4.1. Notice period: If PhysioDock terminates a user’s account for reasons not related to breach of the terms, the user will receive at least 30 days’ written notice.
19.4.2. Method of notice: Notice of termination will be sent to the user’s registered email address.
19.4.3. Access during the notice period: The user will retain access to their services during the notice period, unless otherwise specified.

19.5. Account recovery after termination
19.5.1. Recovery deadline: A deleted account cannot be recovered after 30 days from termination.
19.5.2. New registration: The user may create a new account at any time after termination, but previous data cannot be restored.

20. COMPLAINTS PROCESS

20.1. How users can submit complaints
20.1.1. Complaint channels: Users can submit complaints to PhysioDock in the following ways:

20.1.3. Acknowledgment of receipt: The user receives written confirmation by email within 2 business days after the complaint is received.

20.2. Expected processing time for complaints
20.2.1. Processing time: PhysioDock will process complaints as quickly as possible and normally provides a response within 14 days of receipt.
20.2.2. Complexity: If the complaint requires more time due to complexity or the need for further investigation, the user will be informed of the expected processing time.
20.2.3. Final outcome: When the complaint has been processed, the user will receive a written response with:
– Our assessment of the case.
– Any measures we will implement.
– Information about further avenues for complaint if the user is not satisfied with the response.

20.3. Option to escalate to the Norwegian Consumer Authority
20.3.1. Complaint to the Norwegian Consumer Authority: If the user is not satisfied with PhysioDock’s resolution, the complaint may be escalated to:
– The Norwegian Consumer Authority (forbrukertilsynet.no) for matters concerning consumer rights.
– The Consumer Disputes Commission (forbrukerklageutvalget.no) for further processing if agreement is not reached.
20.3.2. No-cost complaint: Complaints to the Norwegian Consumer Authority are free of charge for the user.

20.4. PhysioDock will seek to resolve disputes through dialogue before legal action is taken
20.4.1. Focus on amicable resolution: PhysioDock is committed to resolving disputes amicably and will seek dialogue and negotiation with the user before considering any legal action.
20.4.2. Mediation: If the parties cannot reach agreement, PhysioDock may propose mediation via an independent third party.
20.4.3. Legal action: Legal action will only be considered if dialogue and mediation do not succeed.
20.4.4. Jurisdiction: Any disputes that cannot be resolved through dialogue or the Norwegian Consumer Authority shall be governed by Norwegian law with the Oslo District Court as the agreed venue.

21. GOVERNING LAW AND DISPUTE RESOLUTION

21.1. Norwegian law applies to the Terms of Use
21.1.1. Governing law: These Terms of Use and any dispute that may arise between the user and PhysioDock.com are governed by and shall be interpreted in accordance with Norwegian law.
21.1.2. Compliance with laws: The user agrees to comply with all applicable laws and regulations relevant to the use of PhysioDock.com.
21.1.3. No international choice-of-law rules: International conflict-of-law rules that could lead to the application of another country’s laws shall not apply.

21.2. Oslo District Court is the agreed venue for any disputes
21.2.1. Venue: If a dispute between the user and PhysioDock.com cannot be resolved through dialogue or alternative dispute resolution methods, the dispute shall be heard by:
Oslo District Court as the exclusive venue.
21.2.2. Place of any legal proceedings: The user and PhysioDock.com agree that all legal actions or proceedings shall take place in Oslo District Court, regardless of the user’s residence.
21.2.3. Norwegian language: Proceedings shall be conducted in Norwegian unless the parties agree otherwise.

21.3. Alternative dispute resolution (mediation) may be used before going to court
21.3.1. Preference for mediation: PhysioDock.com encourages disputes to be resolved out of court through:
The Norwegian Consumer Authority (Forbrukertilsynet) or the Consumer Disputes Commission (Forbrukerklageutvalget) for consumer-related disputes,
or an independent mediator for commercial disagreements.
21.3.2. Agreement to mediate: If both parties agree, a dispute may be resolved through mediation with an independent third party before any court proceedings.
21.3.3. Cost sharing: As a general rule, the parties shall share the costs of mediation unless otherwise agreed.
21.3.4. Deadline for mediation: If the mediation does not lead to a resolution.
21.3.5. PhysioDock may use AI as an advisor during any mediation.

22. MISCELLANEOUS PROVISIONS

22.1. Separability clause
22.1.1. Invalidity of one clause does not affect the whole: If any provision of these Terms of Use is found invalid, unlawful, or unenforceable by a court or other competent authority:
– The invalid provision shall be deemed severed from the remaining terms, and
– The remaining provisions shall continue to be valid and enforceable in full.
22.1.2. Replacement of an invalid provision: Where possible, an invalid provision shall be replaced with a valid provision that best achieves the purpose of the original provision.

22.2. No waiver
22.2.1. No automatic waiver: If PhysioDock.com fails to enforce a term or a right under these Terms of Use, this shall not constitute a waiver of:
– The right to enforce the same term or right at a later time, or
– The right to enforce other terms of the agreement.
22.2.2. Written waiver: Any waiver of a right or term must be in writing to be valid.

22.3. Assignment of rights
22.3.1. Assignment by PhysioDock: PhysioDock.com has the right to transfer its rights and obligations under these Terms of Use to:
– Another company as part of a merger, acquisition, or sale of the business, or
– A subsidiary or affiliated company.
